HIPAA Notice
Effective: August 5, 2026
This HIPAA Notice explains how CareLynk360 expects users to handle Protected Health Information (PHI). It is not a substitute for HIPAA training or the policies of your employer or healthcare facility.
1. CareLynk360 Is Not a Covered Entity
CareLynk360 is a technology marketplace that connects healthcare facilities and caregivers. CareLynk360 is not a healthcare provider, health plan, or healthcare clearinghouse and does not require Protected Health Information (PHI) to operate the Platform. Users should not use CareLynk360 to transmit or store PHI.
2. What Counts as PHI
PHI includes patient names, addresses, dates of birth, medical record numbers, diagnoses, treatment information, photographs of patients, Social Security numbers, insurance information, or any information that could reasonably identify an individual in connection with their health condition or healthcare services. Users must not upload or transmit PHI through the Platform.
3. Use General References Instead
When communicating about shifts or assignments, users should use general terms such as 'resident,' 'client,' 'patient,' or 'assigned individual' without including identifying information. Clinical information should only be communicated through the healthcare facility's approved systems, such as its electronic health record (EHR) or other authorized communication channels.
4. PHI Restrictions
CareLynk360 is not designed or intended to store or process PHI. Users are prohibited from uploading, sending, or storing PHI through profiles, resumes, certifications, messages, shift descriptions, attachments, or any other feature of the Platform. Healthcare facilities remain responsible for complying with HIPAA and all applicable privacy laws.
5. Reporting an Inadvertent PHI Disclosure
If you become aware that PHI has been uploaded or transmitted through CareLynk360, notify us immediately at support@carelynk360.com. Please provide sufficient information to help us locate and remove the content. CareLynk360 will cooperate with affected healthcare facilities in responding appropriately to the incident as required by applicable law.
6. Your Acknowledgement
By creating an account or continuing to use the Platform, you acknowledge that you understand this HIPAA Notice and agree not to upload, transmit, or store PHI through CareLynk360. CareLynk360 reserves the right to remove content and suspend or terminate accounts that repeatedly violate this Notice.
