Terms of Service
Effective: August 5, 2026
1. Acceptance of Terms
By creating an account, accessing, or using CareLynk360, each user agrees to be bound by these Terms of Service. These Terms govern access to and use of the CareLynk360 technology marketplace.
2. Eligibility
Caregivers must be at least 18 years old, legally authorized to work in the United States, and legally capable of entering into binding agreements. Healthcare facilities must operate legitimate healthcare businesses and maintain all licenses required by applicable law.
3. Caregiver Classification
CareLynk360 is a technology marketplace connecting independent healthcare businesses and independent caregivers. CareLynk360 is not the employer of any caregiver and does not hire, supervise, direct, train, schedule, or control caregivers. Healthcare facilities and caregivers are solely responsible for establishing any employment or independent contractor relationship between themselves.
4. Platform Use and Conduct
Users shall not harass others, discriminate unlawfully, falsify credentials, upload fraudulent documents, circumvent platform fees, upload Protected Health Information (PHI), or interfere with platform operations.
5. Credential Uploads
Caregivers may upload resumes, CNA, CMA, CPR, First Aid certifications, licenses, background checks, continuing education records, and similar employment-related documents.
6. Credential Verification
CareLynk360 does not verify, authenticate, certify, endorse, or guarantee uploaded credentials. Healthcare facilities are solely responsible for independently verifying all caregiver qualifications before hiring.
7. Payments and Fees
CareLynk360 charges healthcare facilities platform service fees. Applicable sales tax, currently 8.5% where required by law, is added during checkout. Caregivers and facilities operate as independent businesses or independent service providers. CareLynk360 does not withhold payroll taxes or employee benefits. Where required by law, payments may be reported on IRS Form 1099.
8. Cancellations and No-Shows
Cancellation windows, no-show policies, reliability scoring, and applicable fees are incorporated into these Terms.
9. Background Checks
Where offered, background screening services may be provided through approved third-party vendors in compliance with applicable law.
10. Intellectual Property
All CareLynk360 software, trademarks, branding, graphics, databases, and source code remain the exclusive property of CareLynk360.
11. Disclaimers and Limitation of Liability
CareLynk360 is a technology marketplace and not a staffing agency or employer. The platform is provided AS IS without warranties.
12. Governing Law
These Terms are governed by the laws of the State of Texas.
13. Changes to These Terms
CareLynk360 may revise these Terms by providing reasonable notice through email, the website, or in-app notifications.
